Apple Reuse & Recycling Program

Apple Inc., or any of its affiliates or subsidiaries (collectively, “Apple”) provides this recycling service at no cost to its customers. To the extent permitted by applicable law, Apple hereby disclaims and excludes any and all warranties of any kind, express or implied.

Customer represents and warrants that it has the lawful right to allow Apple to perform the service. Once customer gives Apple a device for recycling, customer transfers title in such device to Apple and disclaims any further right, title or interest in and to the device or any data contained therein. Apple cannot, and does not guarantee, that it will be able to honor any request for return of the device.

Customer agrees that it has the sole responsibility to keep a separate back up copy of any files or data before transferring ownership of the device to Apple. Data recovery is not a part of the service and Apple accepts no responsibility or liability for any lost files or data.

Any items given to Apple as part of this recycling service must not violate any applicable laws, including export laws and customer represents and warrants that it has and shall comply with any and all such laws.

Customer represents and warrants that any items customer seeks to recycle through the service shall not: (1) infringe on any third-party intellectual property right (including copyright, trademarks, patent, trade secrets or other proprietary right) or (2) be counterfeit, stolen, or fraudulent. This service is provided for lawful purposes only, and the Customer agrees to indemnify Apple and any of its directors, officers, employees, affiliates, subsidiaries or agents from and against any claims brought against any of them arising from performing this service on customer’s behalf or for any breach of these terms and conditions by customer.

Apple and its affiliates, employees and agents will under no circumstances be liable for any special, indirect, incidental or consequential damages resulting from this service.

To the extent permitted by applicable law, Apple’s entire liability, if any, from any cause whatsoever with respect to this service shall not exceed HK$150.

This offer is void where prohibited or restricted by law. Apple reserves the right to change these terms and conditions or to cancel this service at any time without notice. This service is not redeemable and has no cash value.
